On Oct. 9, 2009 the United States Court of Appeals for the
Federal Circuit affirmed the opinion of the United States Court
of Federal Claims in Fisher vs United States. This is the
demutualization decision that ruled in favor of the taxpayer
relating to cost basis. The IRS has not said whether it will
appeal to the Supreme Court.

Don't hold off filing your 1040X because time may be running out for
those who sold their demutualized stock early on. The IRS has been
making the refunds (based on a sample of one)
