The company that my son works for has been notified 3 times
of our new address change since November of this year.
However, they never updated the information in their
computer and his W-2 went to the old address. When they
were called today they said they would not correct the
problem or send out a new one until the the old one is
returned to them. Can they do this legally? What if the
old one never gets back to them, how is he suppose to file
his taxes? If it's too late then he get dinged by the
I.R.S. with penalties and late charges, which is totally
unfair. How can we resolve this problem?

It's not illegal if that's what you're asking. That seems
like a logical administrative rule for them to follow.

Well, he could claim it's lost (it would be actually),
request a duplicate, then see if he can pick it up in
person.

Calm down for starters. Then wait a while for the mail to
do it's thing. Talk to the company in an adult voice and see
how best to work it out. Just don't get demanding, as
there's no benefit by doing so. Wait till mid February or
later before you call them.

You mentioned that they were "notified", and that today
"they were called."

Question is, by whom?

If by you, that won't do.

It is your son who worked for the company, and it is he who
should be doing the notifying. It's like I can't notify a
company my wife worked for to change her address. It's a
federal privacy issue.

So yes, they can refuse to honor any address correction
request made by a third party.

Let's take a deep breath. The W-2's aren't due to the
employee until January 31. That's today. If he doesn't
have it by 2/15, worry about it then. He still has 2 months
after that to file his timely return.

If, ultimately, he can't get the W-2, there's a substitute
W-2 procedure explained in the 1040 instructions.
