Can I do eFile with deceased spouse?

How to handle the required spouse signature?

Yes, I am also the executor.

Yes, if you file Married Filing Joint and have not remarried
prior to year's end.

Sign as surviving spouse. Other notations on the top of form
1040 are described in your form instructions (actually all
of the above is included). Read the instructions, you've
paid good tax money for them.

> Yes, I am also the executor.

That's nice, but not relevant to the question, as long as
you are the surviving spouse.

Not for Tax Year 2005 - the season is closed. Yes for 2006
unless they change the rules.

On a 8453 you sign as usual and "Signing as surviving
spouse" is printed in the deceased spouse's spot. (The same
as if you paper filed.) On a PIN filing only you need enter
a PIN.

The same way you would handle any signature required of you
as executor. "Carl Doe, executor of estate of Jane Doe" in
Jane Doe's signature block should work.

The EFile needs the name and date of death of the deceased
spouse and usually a c/o (In Care Of) Name which is usually
the surviving spouse.

If there is a court order appointing surviving spouse as
executor then a copy of that has to be attached to Form 8453
and mailed in after efiling. Otherise if no official
executor a PIN form is allowed and it can be efiled.
