Hi - I hope to get some opinions.

HR block did my returns, and was to get back from the IRS
@2k. I got a letter from the IRS (audit) questioning some
things - I was surprised, as my income is less than 20K.

Gave the IRS request letter to my local HR block office who
did my returns. They said they would take care of it & asked
me to sign a power of attorney. In the meantime I had major
surgery with recuperation.

Two months later I get a registered letter from IRS. The IRS
never heard from my local HR block office, and now I OWE
over 5k!! Talked to the local HR block office - they had a
manager that is no longer with them that bungled my
situation. HR block said they will pay any money I owe.

But can I ask them to pay me what I am owed in a refund? (2K)

No, you can't ask them to pay you what they calculated as a
refund.

You can ask them to help you though correcting their
non-reply error. You can ask for a refund of fees as you
were not satisfied with the service. You can ask them to pay
penalty and/or interest. It may not be a good idea to ask
for all three at once.

They can refuse. But then, you have the better business
bureau, etc.

The policy at H&R Block is to pay any penalties and interest
you owe if they are due to mistakes made by H&R Block. In
addition, if you purchased their "Peace of Mind" extended
service plan, they will also pay any taxes owed (up to
$5000) if it was due to a mistake of H&R Block. So it all
depends on why the IRS says you owe them money. Was it a
mistake by H&R or was it your own mistake (e.g. failure to
provide accurate information.) You haven't really given
enough information for us to come to any conclusions.

If they bungled the original return so that you shouldn't
have received a refund, there's no refund to get. If you
were entitled to a refund (then why did the IRS audit?) you
should still get it. See what the final corrected tax
return looks like first.

Block will pay the interest and penalties, not the taxes.

Hopefully you can file an amended return.
